Words with capitalized initial letters have meanings defined below. These definitions apply whether singular or plural.

Definitions

• Application means the mobile application known as ServiceWindow.com.
• Application Store means Apple App Store or Google Play Store.
• Company (“We”, “Us”, “Our”) means ServiceWindow, Inc., Fallbrook, California.
• Service means the Application, Website, and related services.
• Website means ServiceWindow.com.
• User / You means any individual or entity using the Service.
• Third-Party Provider means any contractor, supplier, service provider, or partner listed, connected, or accessible through the Service.
• Subscription means paid access to features of the Service.
• Content means any information, text, images, or materials submitted to the Service.

2. Acceptance of Terms

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.

You must be at least 18 years old to use the Service.

3. Nature of the Service (Marketplace Disclaimer)

The Service is a technology platform only.

• The Company is NOT a general contractor, subcontractor, supplier, or service provider.

• You assume full responsibility and risk when engaging with any Third-Party Provider.

4. No Endorsement

The presence of any Third-Party Provider on the Service does not constitute endorsement, recommendation, or certification by the Company.

5. Payments and Transactions

Marketplace Payment Structure

• The Company does not process or accept payments for goods or services provided by Third-Party Providers.
• Payments are made directly between You and the Third-Party Provider.
• The Company is not responsible for payment disputes, refunds, or chargebacks.

Subscriptions

Certain features may require a Subscription:

• Billed in advance on a recurring basis
• Automatically renew unless canceled
• Non-refundable except where required by law

If purchased through an Application Store, billing is governed by that store’s policies.

6. Orders and Third-Party Goods

Any order placed through the Service is fulfilled by a Third-Party Provider.

The Company:

• Does not guarantee availability, pricing, or delivery
• Is not responsible for damaged, delayed, or defective goods
• Does not handle returns or refunds

All disputes must be resolved directly with the Third-Party Provider.

7. Safety Disclaimer

You agree not to use the Service while driving or operating machinery.

The Company is not liable for:

• Accidents
• Injuries
• Damages

resulting from distracted or unsafe use of the Service.

8. User Accounts

You are responsible for:

• Maintaining account security
• All activity under your account

We may suspend or terminate accounts for violations of these Terms.

9. Acceptable Use

You agree NOT to:

• Use the Service for unlawful purposes
• Submit false or misleading information
• Attempt to bypass or misuse the platform
• Interfere with system integrity or security

20. App Store Compliance

If you downloaded the Application from an Application Store:

• The Application Store is not responsible for the Service
• The Application Store has no obligation to provide support
• The Application Store is a third-party beneficiary of these Terms

21. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance.
